How an order is formed

Placing an order on the website, or asking us for a quote, is a request to buy. No payment is taken on the website. We will contact you to agree the details and send an invoice. A contract is formed when we confirm your order, which we do once payment has been received. We may decline an order, for example if a machine is no longer available or a price has been listed in error, and will tell you promptly if so.

3

Prices and VAT

All prices on the website are in pounds sterling and exclude VAT, which is added at the current rate on your invoice. Delivery is quoted separately for your address before you commit. We check prices before confirming an order; if a price is obviously wrong we will contact you before going ahead.

4

Payment

Payment is taken in advance. Unless we have agreed otherwise in writing, the full price including VAT and any delivery charge is paid against our invoice, by bank transfer, before the order is confirmed and the machine is booked for delivery or collection. Where a deposit is agreed for a machine built to order, the balance is due before the machine leaves us.

5

Delivery and collection

Machines in stock are delivered within 7 days of confirmation; machines built to order can take up to 3 months. Dates are estimates given in good faith. We are not liable for delays outside our control, such as shipping, customs or weather, but we will keep you informed. You must provide safe access and suitable ground for offloading and have someone present to receive and sign for the goods. Our delivery page sets out what we need. Risk passes to you when the goods are offloaded at your address or loaded onto your transport.

6

Ownership

Goods remain our property until we have received payment in full, even if they have been delivered. Until then you must keep them in good condition, insured, and not sell them or allow a charge over them.

7

Checking the goods

Inspect the goods on delivery or collection and note any damage or shortage on the paperwork. Tell us within 48 hours, with photos. After that, goods are treated as delivered in good condition, without affecting your rights in respect of defects that could not reasonably have been seen.

8

Warranty

New machines are covered by a 12 month parts warranty against manufacturing defects. What is covered, what is excluded and how to claim are set out on the warranty page, which forms part of these terms. The warranty is in addition to your legal rights.

9

Cancellation and returns

Any order can be cancelled before dispatch for a full refund. Consumers buying at a distance also have a 14-day right to cancel after delivery, subject to the conditions on our returns page. Business purchases are not returnable once delivered except where the goods are faulty or not as described.

10

Safe use

Plant machinery is dangerous if misused. You are responsible for ensuring anyone operating a machine is competent and trained, that the machine is used in line with the operator manual, and that it is maintained and inspected as required by law. Machines are supplied UKCA-marked with a Declaration of Conformity and operator manual.

11

Our liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Where you buy as a business, our total liability for any order is limited to the price you paid for it, and we are not liable for loss of profit, loss of business or downtime. Where you buy as a consumer, your statutory rights are not affected.

12

Events outside our control

We are not responsible for failing to meet our obligations because of something outside our reasonable control, including shipping delays, port congestion, strikes, supplier failure or severe weather. We will tell you as soon as we can and agree a way forward.

13

Privacy

How we handle your details is explained in our privacy policy.

14

Law

These terms are governed by the law of England and Wales and the courts of England and Wales have jurisdiction. If you live in Scotland or Northern Ireland you may also bring proceedings there.
