Full warranty terms

Korvex Machinery Ltd provides a 12 month parts-only warranty on new machines. The terms below apply to every purchase. Your rights depend on whether you bought as a private consumer or as a business, so please read the part that applies to you and the general terms at the end.

Version 1.0 · Subject to legal review before go-live.

Part A

Private consumers

You bought the machine for personal use, outside any trade, business or profession.

1

What is covered

Manufacturing defects in non-wearing parts on machines bought new from Korvex Machinery Ltd or an authorised reseller. This is a parts-only warranty. Labour, servicing, call-out fees and any related costs are not included unless we agree them in writing.

2

Warranty period

12 months from the date the machine is delivered to you or collected from our depot. Proof of purchase is required for every claim.

3

Your statutory rights

This warranty is in addition to your rights under the Consumer Rights Act 2015. Nothing in this policy reduces those rights.

4

What is not covered

The warranty does not cover faults caused by:

  • Abuse, including overloading and improper storage
  • Neglect, including missed servicing, incorrect fluids, stale or contaminated fuel
  • Accidental damage, including impact and damage from poor care
  • Misuse, including use outside the machine's intended purpose or rated capacity
  • Normal wear and tear
  • Repairs or modifications not authorised by Korvex
  • External events such as fire, flood, theft or impact

Wear items are excluded. These include tracks, sprockets, idlers, bucket teeth, pins, bushes, filters, fluids, hoses, seals and batteries.

5

How we resolve a claim

Our first step is to supply a replacement part free of charge for you or your own fitter to install.

If you are unable to fit the part, the machine can be returned to Korvex for repair. You are responsible for the cost of return transport. We can arrange collection on your behalf. Before collection you must make sure that:

  • The machine is drained of fuel and oils
  • It is secured to a pallet or is ready for a plant haulier to load
  • It is accessible roadside on a firm, level surface
  • Someone is available on the agreed weekday between 8am and 6pm

Failed collections may be charged.

6

Inspection and repair

When the machine arrives we inspect it. If the fault is covered, we repair or replace the part free of charge. If it is not covered, we send you a quote before doing any work. Return transport must be paid before the machine is sent back to you.

Part B

Business customers

You bought the machine in the course of a trade, business or profession. This includes sole traders, partnerships, companies and hire operators.

7

Basis of the warranty

For business customers this warranty is contractual and is your sole and exclusive remedy. All other warranties, conditions and terms, whether express or implied, including those implied by the Sale of Goods Act 1979, are excluded to the fullest extent permitted by law.

8

What is covered

A 12 month parts-only warranty on the same basis as Part A, subject to the variations below.

Hire operators are covered. For machines used in a hire fleet the warranty period is 12 months or 1,000 engine hours from the date of delivery, whichever comes first.
9

Conditions

The warranty depends on the machine being:

  • Used within its rated operating limits
  • Serviced at the intervals set out in the operator's manual, with records kept
  • Free from unauthorised modification or repair

If these conditions are not met the warranty is void.

10

What is not covered

All exclusions in Part A apply. In addition the warranty does not cover operator error, failure to maintain the machine, or damage from excessive duty cycles beyond the machine's rating.

11

Making a claim

You must submit a claim through the warranty claim form within 7 days of identifying the fault and stop using the machine if continued use could cause further damage. Claims must include the serial number, hour meter reading, a description of the fault and supporting photos or video.

Korvex may inspect and test the machine and may reject claims that do not meet these requirements.

12

Repairs and returns

We will normally supply replacement parts. Where the machine must be returned, you are responsible for all transport costs in both directions. The packaging, draining and collection requirements in Part A apply. Risk in the machine stays with you until it is received by Korvex.

13

Costs and storage

Repairs not covered by the warranty are chargeable and will be quoted before work starts. Return transport must be paid before dispatch. If an invoice for repairs or transport is unpaid 30 days after issue, storage may be charged at £30 per week plus VAT. If storage charges exceed the value of the machine, Korvex may dispose of it to recover costs, after giving you written notice.

14

Limitation of liability

To the fullest extent permitted by law, Korvex's liability under this warranty is limited to the supply of replacement parts, and total liability will not exceed the purchase price of the machine. Korvex is not liable for loss of profit, loss of business, downtime, loss of use, or any indirect or consequential loss.

Part C

General terms

These apply to every customer.

15

Original purchaser only

This warranty applies to the original purchaser and cannot be transferred. Machines bought second-hand are not covered.

16

Scope

Cover applies to non-wearing parts only unless stated otherwise in writing.

17

Changes to this policy

Korvex may update this policy. Changes apply to purchases made after the change and are not applied to existing warranties.

18

Governing law

This policy is governed by the laws of England and Wales. Any dispute is subject to the exclusive jurisdiction of the courts of England and Wales.
